If you are a dutyholder responsible for a water system, your legal responsibilities for legionella compliance include having a legionella control, monitoring and inspection programme in place.
These legal obligations apply to employers, those in control of premises and those with health and safety responsibilities for others, to help them comply with their legal duties in relation to legionella.

The key legislation that dutyholders need to comply with includes:
- Health & Safety at Work Act (1974)
- Health & Safety Executive (HSE) Approved Code of Practise (ACoP) L8
- Health & Safety Executive (HSE) Health & Safety Guidance HSG274
A key component of ACoP L8 – The Control of Legionella Bacteria in Water Systems, is that after a Legionella Risk Assessment is completed a water safety action plan to control the identified risks of Legionella is prepared.
A water safety action plan will identify the chosen control measure and how this will be actioned and implemented. It will also evaluate how often the system should be managed and monitored. A detailed record of all precautions and recommendations should be contained in a dedicated site logbook.
ACoP L8 states that following a Legionella Risk Assessment you are required to prepare a water safety action plan to control the identified risks of Legionella.
Legionella Management Solutions will develop and deploy a scheme of control which will include a logbook which is used to store the records of legionella control and monitoring tasks carried out. This includes:
- Weekly flushing of little-used outlets
- Monthly temperature test results of representative outlets
- Quarterly descaling of shower heads and spray taps
- Annual inspection of calorifiers
- Annual water storage tank inspection
- 24 monthly legionella risk assessment review
- A Water Hygiene Engineer will visit the site at regular intervals to ensure that risks are kept in check whilst carrying out the above
- Temperatures and conditions will be compared with parameters detailed in ACoP L8.
